Terms, Conditions and Disclaimer

We are not responsible for any improper use of the TrafficStep.com program, information, links, articles or any other content gathered from our website. All orders that are placed through TrafficStep.com are subject to the following terms and conditions.

Client acknowledges that by placing an order with TrafficStep.com, Client is representing and confirming to TrafficStep.com that Client has read, acknowledges and fully understands ALL paragraphs of these terms and conditions.  TrafficStep.com reserves the right to modify these terms and conditions without prior notice.  Client shall be responsible for periodically reviewing these terms and conditions and for complying with the then current terms and conditions.   

TrafficStep.com WILL NOT accept ads or websites that contain, provide, or link to content that is not appropriate for viewing by the general public. The following are examples of the type of sites we WILL NOT deliver visitors to: Sites containing or linking to software piracy, pirating, hacking, spamming, excessive violence, obscene or vulgar language, porn, abusive content, illegal schemes, false investment advice or deceptive money-making opportunities or ANY form of illegal activity or material, etc.

Client’s advertisement page can not contain scripts that alter users’ browser settings or contain any frame breaking codes.

If Client’s site is changed during the campaign such that it includes inappropriate content, TrafficStep.com will stop Client’s campaign immediately without any right of Client to receive a refund.

All payments for advertising must be made in full before the campaign will begin TrafficStep.com will use its best efforts to ensure that all services begin within 48 hours from the purchase time.  The date of service may be affected by the amount of pending orders in queue.  All services are conducted on a first come, first serve basis.  Client will know that the purchase order has been accepted upon receipt of a confirmation that the order is in queue.

Visitor campaigns will be completed as set forth in the schedule found in the FAQ section of TrafficStep.com’s website. If we are unable to deliver all of Client’s visitors within the designated time, Client will be eligible for a refund on a pro-rata basis depending upon the actual number of visitors delivered.  Prior to issuing any refunds, TrafficStep.com reserves the right to verify the actual number of visitors delivered, using Client’s raw server logs, which Client shall make available to TrafficStep.com upon request. 

TrafficStep.com cannot be held responsible for factors beyond our control that may interfere with our ability to deliver visitors to Client’s URL.  Such factors include, but are not limited to: problems on Client’s server, including downtime, overuse of Client’s bandwidth quota (if applicable), errors on Client’s site and network outages beyond our servers.  It is Client’s sole responsibility to confirm with its web hosting company or network provider to ascertain whether Client’s hosting account is capable of handling the amount of traffic being ordered through TrafficStep.com.

TrafficStep.com is not responsible for:

·         determining the server bandwidth capabilities of customer sites.  It is Client’s sole responsibility to confirm with its web hosting company or network provider to ascertain whether Client’s hosting account is capable of handling the amount of traffic being ordered through TrafficStep.com;

·         slow server bandwidth;

·         downtime of Client’s server;

·         overuse of Client bandwidth quota

·         incorrect URLs;

·         errors committed by Client or Client’s agents on Client’s website or in the transmission of information;

·         inaccuracy of information from third party “hit counters” on Client’s site regarding number of hits served by TrafficStep.com (such information shall not be binding on TrafficStep.com in determining the actual number of visitors to a Client’s URL);

·         Other factors beyond TrafficStep.com’s control that may affect or interfere with the ability to deliver visitors to Clients URL.

TRAFFICSTEP.COM DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES (1) REGARDING THE TYPES OF VISITORS TO CLIENT’S URL (2) THAT CLIENT WILL GENERATE ANY SALES OR SIGNUPS; OR (3) THAT CLIENT WILL GENERATE ANY INCOME FROM THE USE OF TRAFFICSTEP.COM’S SERVICES.

IN NO EVENT SHALL TRAFFICSTEP.COM, ITS PARENT(S), ANY SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS OR EMPLOYEES BE LIABLE FOR ANY CONSEQUENTIAL, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF INFORMATION OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICES PROVIDED BY TRAFFICSTEP.COM, EVEN IF TRAFFICSTEP.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  MOREOVER, UNDER NO CIRCUMSTANCES SHALL THE LIABILITY OF TRAFFICSTEP.COM, ITS PARENT, SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS EVER EXCEED THE AMOUNT PAID BY CLIENT FOR THE SERVICES RENDERED HEREUNDER.

The use of TrafficStep.com’s services and all matters arising therefrom or related thereto shall be governed by the laws of the State of Georgia and the exclusive jurisdiction for any litigation regarding such matters shall be the state courts in Atlanta, Georgia.
